TERMS & CONDITIONS OF SALE

1. Introduction

These Terms and Conditions of Sale (hereinafter "the Conditions") are in relation to your use of the Order Services provided through the www.hachettepartworks.com (Hereinafter the "Site") website as defined below. Please read these terms and conditions carefully before using the Order Service. If you do not agree with these Conditions, please do not continue to use this website.

2. Definitions

"Contract" means a contract made under these Conditions for the purchase of an Issue or for a Subscription; "Issue" means a single issue of one of the Partworks, as described on the Site, which Hachette will supply in accordance with these Conditions; "Subscription" means a subscription to one of the Series, as described on the Site, which Hachette will supply in accordance with these Conditions; "Hachette" means Hachette Partworks Limited about whom additional information is set out on the "Contact Us" page of the Site; "Series" means the various periodicals or books published by Hachette as described on the Site;

3. Basis of the Sale

By placing an order for an Issue or Subscription you are agreeing to accept these Conditions and any specific conditions applicable to the relevant Series set out elsewhere on this Site. These Conditions, together with any other term set out elsewhere on this Site will govern and be incorporated in every Contract for the sale of Series entered into between Hachette and you.

4. Orders

Orders can be either for individual Issues or Subscriptions as available on the Site. You can manage your orders through the www.hachettepartworks.com Site. Your order is submitted to the acceptance of Hachette. If accepted, your order will be processed. Orders will not be accepted from anyone under 18 years except with a parent's or guardian's authorisation. You are responsible for all uses of your account. It is therefore important for you to protect against unauthorized access to your account and to your computer. Please ensure that you have signed off when you stop using a shared computer

5. Return of an dispatch, reimbursement and cancellation

Return of a dispatch If you are not satisfied with a dispatch, you have the right to return it within 14 (fourteen) days from the day you received it. To exercise this right, simply inform us of your decision by email, telephone, or by sending us the model withdrawal form available here. You may send us back the dispatch, at your own cost, without giving any reason and without any penalty. Of course, you will not have to pay for this dispatch. As soon as we have registered the return of the dispatch, your debt will be cancelled. The dispatch must be returned, sealed, with the invoice, to the following address: Hachette Partworks PO Box 77 Jarrow NE32 3YJ United Kingdom If we do not receive the dispatch, we may arrange to have it collected at your cost. We reserve the right to charge you for any returned dispatch which is not in its original condition. If you keep a dispatch for more than working 14 calendar days from the date that you receive it then you shall be deemed to have accepted that dispatch and you must promptly pay the invoice for that dispatch. Reimbursement If you have already paid for the dispatch, we will reimburse you the cost of the returned dispatch, providing that you request to be refunded in writing when returning your dispatch. Cancellation of a Subscription You are free to cancel your Subscription at any time without giving us any reason, simply by writing or calling us. All the free received gifts are yours to keep. You will not owe any money for any dispatch not yet delivered as at the cancellation date.

6. Prices

The price for an Issue or Subscription will be the price displayed on the terms and conditions of each Series presented on the Site. Unless stated otherwise, all prices displayed on the Site are inclusive of charges for packaging and delivery within the UK and Republic of Ireland, and any applicable value added tax and any other sales taxes unless stated otherwise.

7. Terms of Payment

Unless specified otherwise, you only pay when you receive your dispatch. You can pay by any of the methods set out on the terms and conditions of each Series on the Site, including Cheque, Visa Debit and Credit, MasterCard, and Direct Debit. For Subscriptions, Hachette will retain payment details to take payment when monies are due. We reserve the right to contact you to request an alternative method of payment if our records indicate that the card chosen is about to expire during the Subscription. For one-off purchases of Issues, Hachette does not keep any payment details after the monies have been received. All dispatched products remain the property of Hachette until payment is received. Remittance will not be considered as a payment until the funds are cleared in Hachette's or its agent's bank account. Until full payment is received, Hachette can request the product to be returned at the client's cost. We reserve the right to use a debt collection agency to collect payments that are not paid when due. In such case, Hachette can charge a flat fee of transfer to the debt collection agency.

8. Delivery

Hachette endeavors to deliver the Issues promptly and at the frequency specified in the Serie's terms and conditions. Dispatch will be sent using Royal Mail Service. However, Hachette is not liable for any delay in delivery howsoever caused.

9. Liability

If you notify Hachette (in accordance with Article 10) of any valid claim in respect of any Issue which is based on any defect in the quality or condition of such issue or any product supplied with it, Hachette shall at your option either replace the relevant issue free of charge or refund the issue. Should Hachette be unable to supply you with issues due to circumstances beyond its control, Hachette will notify you of such circumstances and if those circumstances continue for a period of 3 months either you or Hachette may terminate the order for the Issue or (as appropriate) the Subscription immediately. Any advance payments made by you for Issues not delivered by the date of termination will be refunded. Hachette will not be responsible for any loss of profits, revenue, contracts, anticipated savings, data, goodwill or wasted expenditure or any indirect or consequential loss or business loses. Hachette limits its liability regarding use of its website in the Website Copyright and Liability Notice. Nothing in these Conditions will affect your statutory rights relating to faulty or misdescribed goods.

10. Termination

Hachette may cancel any Subscription at any time in writing if you break any of any of your obligations in these Conditions including paying for your Subscription.

11. General

Any notice required or permitted to be given either by you to Hachette or by Hachette to you under these Conditions will be in writing. A notice addressed to Hachette will be sent to its Customer Centre as shown on the "Contact Us" page on the Site. Any notice to be sent to you will be sent to the address for delivery of the Partworks specified in your order. Hachette will try and solve any disagreements quickly and efficiently. Any disputes arising in connection with any Contract of these Conditions shall be governed by English law. Direct Marketing Association Hachette Partworks is a member of the Direct Marketing Association (DMA) and follows the DM Code of Practice (DM Code).

12.1 Specific Terms "Back Issues"

12.1.1 Order

You have missed an issue or you would like to order a specific issue? You have two options: you can ask your newsagent to order it or you can order it from us directly: Either on the www.hachettepartworks.com/shop Or by calling the Customer Service Hotline on 0333 300 1510 for UK and 0333 300 1511 for ROI (local rates apply). We will send your issue upon receiving your payment


12.1.2 Payment

General terms: you must pay for your purchase when ordering. Methods of payment: you can pay via Cheque, Visa Debit or Credit, Mastercard or Direct Debit. Postage and Packaging Delivery charges will be added when you place your order.

12.2 - Specific Terms "Subscription"

Depending on the Series: Prices, Postage and Packaging, Delivery Times, Return Charges, Content, Frequency of the Series can change. Please check specific conditions that might apply to the Series / Back Issues you want to order. These specific conditions are indicated on each Series website..

12.3 - Specific Terms "Direct Debit"

You can choose to pay for your subscription via Direct Debit: Your Direct Debit payment is subject to safeguards assured by the Direct Debit Guarantee. Secure transactions for this website are done via www.jacklin-uk.com that uses a thawte certificate to ensure secure transmission of your information. The amount to be paid will recur automatically every month, 21 days after sending your despatch. It is easy and you don't have to worry anymore about sending your payment! You are free to cancel your Subscription at any time without giving us any reason, simply by writing or calling us and it will stop your monthly Direct Debit payments. All the free received gifts are yours to keep. You will not owe any money for any dispatch not yet delivered as at the cancellation date.
