We all know how the US thrives on the claims culture
But i think this silly woman is taking things a bit far
She wants $5m in damages from Hershey because there was no face or artistic designs on chocolate bar, as shown on the outer packaging she bought for halloween
She has a second claim against another football-themed peanut butter product that doesn't actually feature the laces seen on the packs !!!
God help us if she is successful and claims start here , the industry would collapse , our chocolate bars and other products are never the same as the packaging, usually smaller due to shrinkflation and never actually as appealing as on the wrapper

Everyone knows that the packaging rarely actually represents what is inside these days in the UK. It’s all pretend pictures to get you interested in the product.
To be honest I'd put the woman and her legal team straight into prison. I think its totally unacceptable to pretend that something not resembling what it looks like on the packaging is worth compensation of $5 million. I see that as the crime. However if the manufacturer is to be prosecuted for misleading packaging that should be by the state itself.
BonzoBanana I agree there B, imagine if she won this, that means every person that purchased the same could also claim the same compensation , the companies would go bust with that sort of payout
telmel Yes its totally unacceptable to me. If the company did go bankrupt that is perhaps 1000s of employees who lose their jobs so 1000s of families without an income. Then you have to think about all the companies that supply that company with goods like the chocolate and the packaging etc they have reduced work. Where ever these companies are based will mean less income being spent in that area. Even if the company can absorb the huge financial hit that means extra costs for everyone buying, perhaps 1/2 cent on the cost of every packet to pay these legal costs.
I bought some Tesco toffees a few days ago and one of the toffees inside was without a wrapper going by this logic I probably deserve £200k of compensation.
That's Americans for you, they are driven by money, obsessed with money, especially getting it for nothing
Everytime I read something like this I always think the person must be looking for their 5 minutes of fame or just have too much time on their hands, but some people are just stupid.
She might be onto something though, I'm sure I read about a big fast food chain in America getting sued recently because they were saying the advertising pictures didn't match the products they sell (when does it ever?)
