Do Employees Have the Right to Refuse to Use Their Own Devices for Work?
Ask a Question
So i am a HCA and work in a private home. My company has now started rolling out an app for all staff to log all the information on my client and getting rid of all paper notes.
Now my problem is i do not want the app on my personal phone and the company is not providing a work phone.
Surely it my right to decline the app on my personal phone. Surely it cant be legal to force staff to have this.
Any help greatly appreciated
Cheers rochey2
From what I'm seeing is that having an app on personal phones could put the clients information at risk. Not saying you weill do this far from it but as its your personal phone they run the risk of thd carer on a night out losing the phone and the data accessed. They also run the risk of the apps being left open going home or shop pick up and a child or member of the family accessing the app. A work phone means you're likely to turn the phone off when not at work. Also they need to guarantee you have Internet connection while at work. Are they paying towards the bill
I'm not trying to stress you out just give you the ammo to fight your corner
I would think you would be well within your legal rights to refuse such confidentual information on your personal phone.
If you flat out refuse they certainly can't force you.
Should not have to buy a new phone yourself to do this, of the company wants it on an app they should provide it. I would not like sensitive info like that on my personal device and I would not want my family's info there either
ch7leach I agree. They should provide a work device or at least pay for it since using their app could be seen as an invasion of privacy.
However, Google, Apple, the ISP providers, etc are all tracking our devices so if we truly want to be private then we shouldn't be using smart phones.
Even if you use a VPN it doesn't necessarily give you better privacy if it's some shady VPN company.
My OPINION is that unless your employer supplies the phone or pay for its use they have absolutely no right to insist it be used IN ANY WAY for work purposes.

Got to actually consider whether it is a condition of employment to actually own a mobile phone. I VERY MUCH DOUBT IT.
Don't take any crap from your employer. If they want you to install the app, they should provide the mobile AND the service.
We use an app that can go on our phones and on our work stations, so we have a choice. In theory, if you are working from a modern device (laptop, etc) you should be able to just install the app and use a headset for phone calls

Seems it's all in their favour, using staff to lessen paperwork and have client info on all their phones. Just hope they would back you up if your phone got lost or stolen, or info gleaned by someone outside the workforce.
We use our phones for work but only to receive texts/calls to update us if a contact has been cancelled or added, no private stuff.
