Should Wills Be Split Evenly?

Ask a Question

Should wills be split evenly? 🤔

A woman recently sparked a heated debate after admitting she convinced her mum to change her will. She argues her sisters barely helped out, so she should get more. However, not splitting things equally can destroy relationships. What do you think?

My mum's will destroyed my family, greedy brother who did nothing for her wanted everything, even took it to court to get her house, he claimed her will was made while she was on morphine so was invalid which wasn't true, he didn't win the case thankfully, he is now dead to me

martinlufc5637 Reminds me of my dad's side who are a bunch of greedy, selfish, jerks.

I honestly rather never see them again and they aren't family to me anymore.

MISSMESSY it happened a few years ago but still leaves a bitter taste in my mouth, there is no way back for him in our family, he reached out at Christmas, I ignored him, the whole experience was very unpleasant

What's the point in having a will if people will go to court and try and change it? When they don't like what the person has put in it? I find it madness it should be what's in the will end off

Leannexxx that's what the judge said in our case, he told me brother that he was a greedy selfish man, and the case he brought to court was ridiculous , he didn't like the fact mum left me the house, which I still own and rent out, she left me it because I cared for her and she didn't want him to have it, she left him nothing

martinlufc5637 well it's his own fault then I love the fact people think they should be in the will for doing nothing when my uncle died he didn't have a will so he had to split 3 ways he was grateful and wished he had a better relationship with him now one of his sisters wasn't happy at all because when they sold his house she wanted more money

Unfortunately greed can kick in with siblings and my brother convinced my father by taking him to the solicitor to make a will mainly in his favour!

I find it sickening that people argue over such things. Our parents split everything equally 3 ways. Me & my siblings cleared our parents property together too & never had a single dispute about who got what.

Iv seen arguments in the wider family tho. I know an Aunt of ours had made a list of my grandpas items she wanted BEFORE he was even ill. No idea if she got it all. It sickens me tbh.

I can't understand how someone could accept anything in good conscious thst they knew the deceased didn't want them to have anyway.

In this case it's the mother's decision to decide her will but usually splitting things equally is a good idea if possible

People's wills should always be honoured if it's their last wishes and hasn't been unfairly influenced. If someone for example decided to give all their assets to an animal charity because that is what they wanted to do so be it. Courts should not be able to change that. I find it disgusting to be honest. I don't think people have a right to be included in a will.

It is up to the person that is writing the will how they want to divide their assets. I have already told my parents if they want to leave everything to the local cat home it won't bother me. I'm not after their money and it is theirs to do as they please.

The legal team writing my will made sure that those not left anything but probably expecting something were mentioned specifically so that there should be no contesting the will when the shareout happens. You can probably guess who is likely to be unhappy but hopefully you can bypass it with the right advice.

Wills are made by the individual they should decide how it gets split a d what gets left to who, it's bad when some members influence that decision but it's ultimately one one person's choice to contest it over the fact someone got more than you is dumb.

I’ve given my kids all my nice jewellery cos I don’t want them to look at the jewellery with sadness- they wear it now which is nice.

I just opened my jewellery box and said go for it ! I gave them the history of each piece too etc.

ive left incredibly strict instructions about my cats though!

The rest will just be split equally as i see them all equally.

suevernon1968 ...That's a nice way of doing things while you are alive so when your children wear the items of jewellery they chose to take they will know the history behind the pieces & remember their Mum fondly...xx

janphoenix51 I sound lovely dont i ? Lol - don’t be fooled- I’ve also left them one piece each (picture, ornament, vase stuff like that) that I know they really dont like lol. They know my sense of humour so they will see the funny side. Death is so depressing for the people left behind I’m trying to bring a little smile into it. I can expect that when they realise what I have done- they will have a chuckle and say something like ‘trust our mum’ x

suevernon1968 ...Yes, I know that one too, my late Nephew had these pottery blue & white statues in the rented house he had to take after his ex took the home & contents they bought that he had worked so damn hard to buy while supporting her through college. I ended up with those statues when he died, not my taste & certainly not his, just something to fill the empty shelf in his rented place that someone found from a charity shop..

janphoenix51 but I bet you can’t throw them away can you?

I have also left some money to cancer research. And I keep my clothes on two separate rails - stuff nice enough to go to a charity shop and stuff that can go in one of the clothing recycling bins that seem to be everywhere.

I believe it should be split evenly but every family is different. As far as I know my mum has split hers between my brother and me but my brother is not a well man so not sure what the future holds.

NO - I Will should be a Will

I have been on the sharp end of this (through sibling coercion) but still think that people are entitled to Will their estate as they see fit.

suevernon1968..What's happening with your cats & how many do you have??

My oldest friend used to donate to animal charities when we were out in Sheffield years ago, saying that humans can look after themselves..

janphoenix51 i have 5. Two absolutely have to stay together. One ginger one white they adore my nephew and his partner- to the point of climbing up them using their claws !

The other three dont give a damn about each other really - but I have a close friend who loves cats as much as I do and before her bum has properly settled in the sofa all three cats are trying to sit on her lap.

I have had loads of people saying they will look after them - but no matter how much I love the person doesn’t matter. Its how much the cats love the human that matters x

Our two cats Topaz & Phoenix will be well provided for if anything happened to either my partner or me..

You get some vile people who have shown no interest in the person while alive yet expect to be included in a will. However even if the person who has died is a horrible person leaving nothing to their children for no reason that is still their choice and their assets. To try to change that is basically theft taking someone's property or money against their wishes.

Its sad people feel this way. My mums will is not split evenly (she is still alive, she has told me this herself). My brother gets her house and I get nothing, at first I was a little miffed but I understand her reasoning and its not my decision to make. Money/possessions should not become between family.

Currently on holiday in Portadown, our hostess J told us last time we stayed here 2 years ago about a mother & her daughter who came over from America after their Irish relation had passed away.

They were staying with our hostess & told her the story of why they were over from America. It turns out their relative had no one left apart from those two whom he never saw & the lady next door who cooked, spent time with him & had taken him to appointments when he was ill.

The elderly Irish man had left his kind neighbour some items from his house but left his selfish relatives the house, the Mother told our hostess that she wanted everything & she & the daughter couldn't understand why the man had left the lady next door anything despite the lonely old man being looked after by her.

Our hostess told us the mother & daughter were only in Portadown to get what they could before swanning back to the States "Where everything was bigger & better" according to them, hostess couldn't believe how brazen they were & couldn't wait to get rid of them!!!

Well i don’t see how it could be banned as surely people should be free to do with their money what they want.

What's in a will is the decision of the person that's writing it. I have a friend who's parents have left the house to him and very little to his two sisters, the reason behind this is the two sisters do nothing for them but their brother does, there's going to be a big fall out at a later stage.

No a will unless written when a person isn't compess mentess is that the person wants. Why should wills be split equally if you've 2 kids and 1 who pretty much treats the family like dirt why should they get half of the will
